MainePERS tracks proposed legislation related to the programs we administer during each legislative session. Below you will find the legislation introduced during the current session of the Maine Legislature. Included is a brief overview of the bill, a copy of the original proposed legislation (which is referenced by its legislative document [LD] number and title) along with any testimony submitted by MainePERS regarding the proposal.

LD 70 – An Act to Eliminate the Cap on Retirement Benefits for State Employees and Teachers to Which a Cost-of-Living Adjustment is Made
This bill would provide for a cost-of-living adjustment (COLA) on the entire benefit for retired state employees and teachers.
LD 106 – An Act to Standardize Service Credit Qualifications for State Retirees
This bill would change how service credit is earned and retirement benefits are calculated when a member transfers from a special plan to a regular plan.
LD 185 – An Act to Reduce the Benefit Penalty Imposed on Career Educators Who Retire After 35 Years of Service
This bill would change the amount by which benefits of certain school administrators and teachers who retire early would be reduced.
LD 197 – An Act to Address Employee Retention at the Maine State Police Crime Laboratory and the Computer Crimes Unit in the Department of Public Safety
This bill would change the retirement plan by which certain civilian employees in the Department of Public Safety, Maine State Police Crime Laboratory and the Computer Crimes Unit are covered.
LD 206 – An Act to Make Supplemental Appropriations and Allocations from the General Fund and Other Funds for the Expenditures of State Government and to Change Certain Provisions of the Law Necessary to the Proper Operations of State Government for the Fiscal Year Ending June 30, 2023
This bill is the proposed Supplemental Budget for Fiscal Year 2023. Part J of the language would provide eligible retirees from the State-sponsored Plans with an additional cost-of-living adjustment.
LD 313 – An Act to Ensure Consistency in Retirement Plans for Certain Law Enforcement Officers
This concept draft proposes to align retirement plan provisions for certain law enforcement officers.
LD 426 – An Act to Amend the Eligibility Criteria for Creditable Service in the Armed Forces of the United States Under the State Retirement System
This bill would expand the periods of military conflict for which members may be permitted to purchase retirement service credit at a subsidized rate.
LD 483 – An Act to Amend the Laws Governing Retirement Benefit Reductions for Certain Employees Currently Included in the 1998 Special Plan
This bill would change how benefits are calculated for certain employees of the Department of Corrections.
LD 610 – An Act to Expand the 1998 Special Retirement Plan to Include Employees Who Work for the Office of Chief Medical Examiner
This bill would change the retirement plan by which certain employees in the Office of Chief Medical Examiner are covered.
LD 635 – An Act to Allow a Retired Law Enforcement Officer to Serve as a School Resource Officer Without Affecting that Officer’s Retirement Benefits
This bill would allow a retired law enforcement officer to serve as a school resource officer without an impact on retirement benefits under certain conditions.
LD 733 – An Act to Require an Annual Itemized Statement of Benefits for Public Employees and Retirees
This bill requires public employers and MainePERS to provide annual statements to employees and retirees.
LD 742 – An Act to Divest State Pensions from Companies Boycotting Maine Lobster
This bill requires MainePERS to no longer invest in companies that are boycotting Maine Lobster and to divest of current such holdings. Divestment and Investment decisions would be made in accordance with sound investment criteria and consistent with the Board of Trustees fiduciary obligations.
LD 882 – An Act to Allow Nonmunicipal Emergency Medical Services Providers to be Considered State Employees for Purposes of Certain Benefits
This bill would allow certain nonmunicipal emergency medical service providers to participate in the MainePERS Participating Local District Consolidated Retirement Plan.
LD 926 – An Act to Improve Maine Public Employees Retirement System Representation
This concept draft proposes to improve MainePERS representation.
LD 1023 – An Act to Strengthen Maine’s Financial Future in Perpetuity by Establishing the Irrevocable Budget Trust Fund
This bill would create an Irrevocable Budget Trust for which MainePERS would invest a portion of the funds.
LD 1082 – An Act to Advance the Maine Retirement Savings Program
This bill would make several changes to the Maine Retirement Savings Program.
LD 1096 – An Act to Help Retired Teachers and State Employees Keep Pace with Inflation by Matching the Cost-of-Living Adjustment for Social Security Benefits
This bill would change the Consumer Price Index on which cost-of-living adjustments for MainePERS retirees is based and remove the 3% cap on the amount of increase that is paid.
LD 1123 – An Act to Create a Presumption That a Cardiovascular Injury or Disease or Pulmonary Disease Suffered by Certain Law Enforcement Officers Is in the Course of Employment
This bill would establish a rebuttable presumption of disability for law enforcement officers with specific medical conditions.
LD 1152 – An Act to Make Long-term Disability Insurance Coverage Available to Public Employees
This bill would require MainePERS to offer long-term disability insurance coverage and would require employers to pay for the coverage.
LD 1230 – Resolve, Directing the Maine Public Employees Retirement System to Study the Creation of an Interstate Compact Concerning the Windfall Elimination Provision and Government Pension Offset
This resolve directs MainePERS to study the creation of an interstate compact with other states affected by the government pension offset (GPO) and the windfall elimination provision (WEP)
LD 1424 – An Act to Remove the Age Requirement for Correctional Staff Retirement Under the 1998 Special Plan
This bill would change how certain Department of Corrections employees are covered under the 1998 Special Plan.
LD 1499 – An Act Regarding Penalties for Early Retirement for Certain Members of the Maine Public Employees Retirement System
This bill requires a recalculation of retirement benefits based on a decreased early retirement reduction for certain state employee and teacher retirees.
LD 1562 – An Act to Protect the Retirement of State Employees and Teachers by Establishing Standards for Fiduciary Responsibility
This bill establishes standards of care for fiduciaries of the Maine Public Employees Retirement System.
LD 1607 – An Act to Stabilize the Pension Funds of the Maine Public Employees Retirement System
This bill requires that a portion of any surplus General Fund revenue be transferred to a fund to pay for retirement benefit improvements.
LD 1759 – An Act to Clarify the Disability Retirement Program of the Maine Public Employees Retirement System
This bill would make several changes to the laws that govern the disability retirement program administered by MainePERS.
LD 1760 – An Act to Include Certain Crisis Outreach and Crisis Services Workers Under the 1998 Special Plan for Retirement
This bill would change the retirement plan by which Crisis Outreach and Crisis Services Workers are covered.
LD 1761 – An Act to Include Certain Mental Health Workers Under the 1998 Special Plan for Retirement
This bill would change the retirement plan by which certain Mental Health Workers are covered.
